1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of the BealTech website and your purchase or use of products and services provided by BealTech, LLC ("BealTech," "we," "us," or "our").

By using our website, submitting an order, or using our services, you agree to these Terms. If you do not agree with these Terms, you should not use our website or our services.

2. About BealTech

BealTech, LLC is a technology business providing custom-built and prebuilt computer systems, computer diagnostics, repairs, and related technology services.

3. Products and Services

BealTech may offer computer systems, hardware, accessories, repair services, diagnostic services, and other technology-related products or services.

Product availability, specifications, configurations, and services may change without notice.

4. Product Information and Pricing

We make reasonable efforts to ensure that product descriptions, specifications, images, availability, and pricing displayed on our website are accurate.

However, errors may occasionally occur. BealTech reserves the right to correct typographical, pricing, specification, or availability errors and to cancel an order affected by an obvious order.

Product images may be representative and may not always depict exact final configuration. Hardware components may be substituted with equivalent or better components when necessary due to availability, compatibility, or supply constraints, provided that such substitutions do not materially reduce the advertised functionality of the system.

5. Orders and Payment

An order submitted through the website constitutes a request to purchase the selected product or service. BealTech reserves the right to accept, reject, or cancel an order for legitimate reasons, including product availability, pricing errors, suspected fraud, or inability to fulfill the order.

Payment must be successfully received before an order is paid. Additional payment terms may be provided during checkout or in an applicable invoice.

You agree to provide accurate billing, shipping, contact, and other information necessary to process your order.

6. Shipping and Delivery

BealTech may ship products using third-party carriers. Shipping estimates are estimates only and are not guaranteed delivery dates unless expressly stated otherwise in writing.

Once a shipment has been transferred to a carrier, delays caused by the carrier, weather, natural disasters, transporation disruptions, or other circumstances outside BealTech's reasonable control may affect delivery.

Customers are responsible for providing an accurate shipping address. Additional charges or delays resulting from an incorrect or incomplete address may be the customer's responsibility.

7. Returns and Cancellations

Returns, cancellations, and refunds are subject to the return terms presented for the applicable product or service at the time of purchase.

A return or refund does not alter or replace the terms of BealTech's separate limited assembly warranty.

Custom-built systems, special-order components, opened products, or services may be subject to additional return restrictions where permitted by applicable law and disclosed before purchase.

8. Limited Assembly Warranty

BealTech provides a one-year limited warranty covering the assembly and workmanship performed by BealTech on qualifying computer systems.

This warranty does not replace or extend the manufacturer's warranty applicable to individual components. Component failures are generally handled under the applicable manufacturer's warranty.

9. Repairs and Diagnostics

Diagnostic and repair services are separate services unless expressly included with a product or otherwise stated in writing.

Before performing chargeable repair work, BealTech may provide an estimate or obtain customer authorization. Additional work may require additional authorization.

Customers are responsible for informing BealTech of known passwords, encryption, account restrictions, or other conditions that may prevent necessary testing or service.

10. Customer Data

Customers are responsible for maintaining backups of important data before submitting a device for repair, service, or modification.

BealTech is not responsible for loss, corruption, disclosure, or inability to recover customer data resulting from servicing a device, except where such responsibility cannot lawfully be excluded.

Customers should remove sensitive or unnecessary information from a device before submitting it for service whenever practical.

11. Intellectual Property

The BealTech name, logo, website design, original text, graphics, and other original website materials are owned by or licensed to BealTech and may not be reproduced, modified, distributed, or used without permission except as permitted by law.

Hardware manufacturers retain ownership of their respective trademarks, logos, software, and intellectual property.

12. Website Use

You agree not to misuse the BealTech website or attempt to interfere with its normal operation.

This includes, without limitation:

• Attempting to gain unauthorized access to our systems or accounts
• Interfering with website availability or functionality
• Submitting malicious code or harmful content
• Using automated systems in a manner that unreasonably burders our infrastructure
• Attempting to obtain information that you are not authorized to access
• Using the website for unlawful purposes

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the BealTech website and its content are provided on an "as is" and "as available" basis.

BealTech does not guarantee that the website will always be available, uninterrupted, error-free, or free from harmful components.

Nothing in these Terms is intended to exclude any warranty or consumer protection right that cannot lawfully be excluded or limited.

14. Limitation of Liability

To the fullest extent permitted by applicable law, BealTech will not be held liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the user of our website, products, or services.

To the extent permitted by law, BealTech's total liability from a particular transaction or service will not exceed the amount paid to BealTech for the specific product or service giving rise to the claim.

These limitations do not apply where prohibited by applable law.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless BealTech, its owners, and its representatives from claims, damages, liabilities, and expenses arising from your unlawful use of the website, violation of these Terms, or intentional misuse of BealTech's products or services.

16. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except where applicable law requires otherwise.
